Plaintiff appellant State of Idaho brings this appeal from a district court decision in an action brought against defendant respondents under the Idaho Consumer Protection Act. The state sought injunctive and restitutionary relief on behalf of all Idaho consumers who purchased water conditioners from defendant respondents. Following a court trial, the district court enjoined defendant respondents Master Distributors, Inc., Kenneth Merrill, Sr., and Kenneth Merrill, Jr., from further violations of the Idaho Consumer Protection Act. Between September, 1972, and July, 1973, defendant respondent Master Distributors, Inc., a closely held Idaho corporation owned and controlled by defendant respondents Kenneth Merrill, Sr., and Kenneth Merrill, Jr., sold United Standard Commercial water conditioners in a door to door sales campaign in several southern Idaho communities. Master Manufacturing Co. was a manufacturer and wholesale distributor of United Standard Commercial water conditioners located in California and wholly owned by Lowell Foletta. Master Manufacturing provided Master Distributors, Inc., scripts for use in telephone solicitations, a written and illustrated sales presentation to be given in the homes of sales prospects, and the United Standard Commercial water conditioners.
